1.3 SMS & Text Message Data
Our Service sends and receives SMS text messages to and from caregivers on behalf of home care agencies. We collect the content of SMS messages exchanged through our platform (e.g., shift notifications, caregiver responses) and related metadata (timestamps, phone numbers) solely to operate the Service.
2. How We Use Your Information
We use the information we collect for the following purposes:
- Provide and Operate the Service: To send shift-callout notifications, process caregiver responses, confirm shift coverage, and deliver the core functionality of our platform.

3. SMS / Text Messaging Consent (TCPA Compliance)
We comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations regarding SMS communications.
- Prior Consent: SMS messages are sent only to caregivers whose phone numbers have been provided by their employing home care agency, which represents that it has obtained appropriate consent from each caregiver to receive shift-related text messages.
- Opt-Out: Recipients may opt out of receiving SMS messages at any time by replying STOP to any message. We honor all opt-out requests promptly and at no cost.
- Help: Recipients may reply HELP to any message to receive customer-care contact information.

- Message & Data Rates: Standard message and data rates may apply. We are not responsible for charges imposed by your wireless carrier.
- No Sale of Phone Numbers: We do not sell, rent, or share phone numbers or SMS opt-in data with third parties for marketing purposes. Phone numbers collected for SMS notifications are used solely to deliver the Service.
- Program Details: For full SMS program details, see our SMS Messaging Program Terms.
4. Healthcare Information
tecbu is a workforce scheduling and shift-coverage tool. Our Service is designed to handle caregiver availability and shift logistics—not patient health records or protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA). We do not knowingly collect, store, or process PHI through our platform. If a customer requires a Business Associate Agreement (BAA), please contact us to discuss your specific needs.
5. How We Share Your Information
We do not sell your personal information. We may share information in the following limited circumstances:
- Service Providers: We share data with trusted third-party vendors who help us operate the Service (e.g., SMS delivery providers, cloud hosting, analytics). These providers are contractually obligated to use your data only to perform services on our behalf and to maintain appropriate security measures.
- Agency Clients: Caregiver shift responses and coverage confirmations are shared with the employing home care agency that uses our platform.
- Legal Requirements: We may disclose information if required by law, court order, subpoena, or other legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety, or the safety of others.
- Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.
6. Data Security
We implement commercially reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, use, alteration, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
